These terms apply to the Portion Monitor app for Android, published on Google Play under the package name com.portionMonitor.app by Tiny apps ("we", "us"). By installing or using the app you agree to them. If you do not agree, do not use the app.

The short version. Portion Monitor is a diary, not medical advice. Your data is yours and stays on your phone. The app is free and shows ads. We do our best to keep it working and we are not liable for decisions you make from the numbers in it.

1. What the app is

Portion Monitor lets you record food portions, water, caffeine, steps, exercise, weight and waist, set daily goals, and see reports and reminders based on what you record. It is provided free of charge, supported by advertising.

2. Not medical advice

The app, the bundled portion guide, and every figure it shows, including BMI, healthy weight ranges, body fat estimates, goal states and the starter plan, are general information calculated from numbers you enter. They are not medical advice, a diagnosis, or a treatment or diet plan, and they are not a substitute for a doctor, dietitian or other qualified professional. Talk to one before changing how you eat or exercise for a medical reason, and do not ignore professional advice because of something the app shows. If you have or suspect an eating disorder, please seek help before using any food diary.

3. Your data

Everything you enter belongs to you. It is stored on your device, and optionally in your own Google Drive if you turn backup on, as described in the privacy policy. We never receive it. You are responsible for keeping copies you care about: use the CSV export or Drive backup, because uninstalling the app or losing the phone removes what is on it, and we cannot recover it.

4. Google Drive backup and restore

Backup and restore use your Google account and Google's services under Google's own terms. Restoring replaces what is on the phone. The app keeps a local recovery copy before doing so, but we cannot guarantee that a backup made on one version restores perfectly on another, and we are not responsible for data lost through a failed backup, a failed restore, or a change to your Google account.

5. Advertising

The app shows ads served by Google AdMob. Ads are provided by third parties; we do not endorse what they advertise and are not responsible for their content or for anything you buy or do after tapping one. Your ad privacy choices are available in the app, as described in the privacy policy.

6. Shared setup links

You can share your goals, reminders and units as a link. Anyone with the link can see and apply that setup, so share it only with people you intend to. Applying a setup someone sent you is your choice; the app shows what would change and asks first.

7. Acceptable use

Do not reverse engineer, decompile, resell, or redistribute the app or the portion guide content, interfere with the ad service, or use the app for anything unlawful. Play's own terms for apps you install from it also apply.

8. Intellectual property

The app, its name, icon, design and the portion guide text are ours or licensed to us. These terms give you a personal, non-transferable licence to use the app on Android devices you own or control. They do not transfer ownership of anything.

9. Availability and changes

We may update, change or discontinue the app or any feature at any time, and we may change these terms. Material changes are posted on this page with a new date at the top; continuing to use the app after a change means you accept it. Because the app keeps your data on your device, a discontinued app still keeps what you logged, and the CSV export still works.

10. No warranty

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of the figures it shows. We do not promise that it will be error-free, uninterrupted, or that reminders will arrive at the exact minute you set.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss of data, arising from your use of or inability to use the app. Nothing in these terms limits liability that cannot be limited under the law that applies to you, and nothing affects the consumer rights you have under that law.
